Estimates may only be accepted on, and are expressly limited to acceptance of, the terms described herein. Enviro-Equipment’s New and Used Purchased Remediation Equipment Warranty and Returns Policy, Enviro-Equipment’s Rental/Service Agreement Terms and Conditions, and Enviro-Equipment’s Invoice Terms and Conditions are incorporated herein by reference. Acceptance of this estimate by the buyer shall be deemed as acceptance of all of these terms.
- Enviro-Equipment assumes the information provided by the buyer is the full extent of the information necessary to determine the scope of the estimate. It is the responsibility of the buyer to provide all information necessary to prepare the estimate to Enviro-Equipment. In the preparation of the estimate, Enviro-Equipment cannot consider any information germane to the project not provided by the buyer. This includes but is not limited to: local and federal applicable codes, government regulations, site conditions, project specifications, available electric power, hazardous location classifications, etc. Any errors or omissions in the proposal resulting from unidentified legal or technical requirements are outside the scope of this estimate, and Enviro-Equipment will not be responsible for them.
- No changes shall be made in the estimate or purchase order unless agreed to by the seller in writing. Orders resulting from this estimate are not subject to conflicting terms in the customer’s confirming purchase order.
- Pricing is subject to credit approval, Net 30 days, or as stated in the estimate. Terms stated within the estimate take precedence.
- The quoted price does not include sales, use, excise, or similar taxes except as noted in the estimate. If sales taxes are quoted as a component of the price, such tax amounts have been calculated based on representations by the buyer. The buyer retains responsibility for any sales, use, excise, or similar taxes not expressly outlined in the estimate and paid by Enviro-Equipment on the buyer's behalf.
- All items in the estimate will be shipped F.O.B. Enviro-Equipment or F.O.B origin point if drop shipped. Enviro-Equipment shall not be responsible nor liable for any damage, including any loosening or disconnecting of piping, fittings, conduit, or wire connections from vibration caused by the freight carrier during shipping. Acceptance of freight by the carrier is an acknowledgment that containers or the method of shipping were acceptable when picked up.
- The estimate is valid for thirty (30) days unless otherwise stated in the estimate. Used equipment is sold on a first-come, first-served basis. Any estimate that includes used equipment may be rendered invalid without prior notice if the used equipment is sold to another customer.
- Issuance of a purchase order or notice to proceed constitutes the acceptance of Enviro-Equipment’s Estimate Terms and Conditions, Enviro-Equipment’s New and Used Purchased Remediation Equipment Warranty and Returns Policy, and Enviro-Equipment’s Invoice Terms and Conditions. In the event of a conflict with any customer terms, Enviro-Equipment’s terms shall take precedence.
- Enviro-Equipment is not responsible for any discrepancies between the written RFP documents and the RFP drawings. Pricing is limited to only those items described in the estimate. Accidental errors or omissions in interpreting the bid documents may require additional costs.
- Pricing is based on the equipment specified. No additional pressure loss calculations have been performed. The actual mechanical installation of the system may require pipe, fittings, or instruments that impact operational flows, vacuums, and pressures.
- Sizing and costs for equipment containers, sheds, trailers, or skids may change based upon engineered and scaled drawings during the submittal process.
- Every effort will be made to locate flow sensors/meters in desired locations. However, installation per manufacturer’s specifications may be influenced by enclosure or skid sizing and/or system operating temperatures and pressures.
- A third-party inspection (UL/NFPA) of the entire system is NOT included unless specifically listed in the estimate but may be required by the local jurisdiction responsible for the inspection of the system. It is the responsibility of the buyer to determine if a third-party inspection is necessary. If a third-party inspection is required but was not included in the estimate, the buyer is responsible for all costs for the third-party inspection. Payment will not be delayed or withheld due to the third-party inspection.
- All systems that include a PLC (Programmable Logic Controller) or HMI (Human Machine Interface) may need a phone line or internet connection with a static IP address depending upon the type of PLC or HMI. The buyer is responsible for all costs and labor associated with establishing and maintaining the phone or internet service.
- If the customer is unready to accept shipment at the time of notification to ship, the customer will advise Enviro-Equipment in writing of the reason for the delay, anticipated readiness date, and acknowledgment of ownership of the equipment as of the notification to ship date. Enviro-Equipment will store the equipment for 30 days free of charge. The customer will be invoiced monthly storage charges at a rate of $5.00 per square foot per month, plus any applicable one-time mobilization charges to relocate equipment to a storage facility other than Enviro-Equipment.
- No costs for permitting, inspections, or P.E. Sealed Drawings are included unless otherwise stated.
- On-site construction services, on-site ancillary piping, or on-site electrical work are not included in this estimate unless otherwise stated.
- Equipment offloading services at the destination or job site have not been included unless otherwise stated.
- The estimated lead time stated in the estimate is based upon our current schedule and general parts availability and is subject to change at any time without notice. Enviro-Equipment will not be liable for any damages resulting from delays in shipment past the estimated completion date for any reason whatsoever.
- Pursuant to NEC Article 409; Enviro-Equipment provides U.L. or U.L. Equivalent listed industrial control panels manufactured with short circuit current ratings (SCCR) of 5kA as standard product. The need for an alternate SCCR must be communicated in writing to Enviro-Equipment prior to placing any order.
- Not having any ambient sound level data regarding the site, Enviro-Equipment cannot guarantee meeting any sound level requirement if specified.
- Steel shipping containers are not NFPA certified with fire wall ratings. They may not meet national fire code requirements.
- Due to the volatility of fuel costs, transportation quotes/estimates older than one week will be re-quoted and may result in additional costs.
