New and Used Remediation Equipment Warranty and Returns Policy

New Equipment NOT Manufactured by Enviro‐Equipment

  1. All new equipment NOT manufactured by Enviro‐Equipment carries the manufacturer’s warranty and begins on the date the manufacturer states.
     
  2. Should any new item NOT manufactured by Enviro‐Equipment become defective within the warranty period, Enviro‐Equipment, Inc. will coordinate with the manufacturer for the return of the equipment for evaluation in accordance with the manufacturer’s warranty, repairs, and returns policy. After evaluation, if the equipment is deemed defective by the manufacturer, it will be repaired or replaced by the manufacturer in accordance with their warranty.
     
  3. All shipping, freight, removal of equipment, preparation for shipping, and evaluation costs are the responsibility of the buyer for items shipped for evaluation, repair, or replacement.
     
  4. All items will be shipped F.O.B Enviro‐Equipment or F.O.B origin point if drop shipped. Enviro‐Equipment shall not be responsible or liable for any damage, including any loosening or disconnecting of piping, fittings, conduit, or wire connections from vibration caused by the freight carrier during shipping. Acceptance of freight by the carrier is acknowledgment that containers or the method of shipping were acceptable when picked up.
     
  5. All warranty claims must be filed with the proper documentation deemed by the manufacturer and within the manufacturer’s warranty period to be honored.
     
  6. All warranties on new equipment NOT manufactured by Enviro‐Equipment are contingent upon the proper installation, use, and storage of the equipment, as stated in the manufacturer’s warranty. The warranty will not apply if the equipment is misused, subjected to unusual physical stress, neglected, wired, plumbed, mounted or installed incorrectly, not to manufacturer specifications, connected to a deficient power source, or damaged because of improper storage. The buyer assumes all liability for the misuse, installation, or improper storage of the equipment by the buyer, the buyer’s employees, and all others.
     
  7. ENVIRO‐EQUIPMENT WILL NOT BE LIABLE FOR SPECIAL OR CONSEQUENTIAL DAMAGES IN ANY CLAIM, SUIT, OR PROCEEDINGS ARISING UNDER WARRANTY. NOR WILL ENVIRO‐EQUIPMENT ACCEPT ANY LIABILITY FOR CLAIMS FOR LABOR, LOSS OF PROFIT, REPAIRS, OR OTHER EXPENSES INCIDENTAL TO REPLACEMENT. IN THE CASE OF ENVIRO‐EQUIPMENT’S SOLE NEGLIGENCE, IN NO CIRCUMSTANCE SHALL ENVIRO‐EQUIPMENT’S LIABILITY EXCEED THE PURCHASE PRICE OF THE EQUIPMENT.
     
  8. Enviro‐Equipment expressly disclaims any express or implied warranties, including any warranty of fitness for a particular purpose, merchantability, or any warranty arising from a course of dealing or usage of trade. Enviro‐Equipment shall not be liable, in tort, contract, or otherwise, for any loss or damage, whether direct, consequential, or incidental, of any person or entity arising in connection with the equipment, except to the extent required by applicable law.
     
  9. Warranty claims will not be accepted if the customer’s account has any past due invoices.

New Equipment Manufactured by Enviro‐Equipment

  1. All new equipment manufactured by Enviro‐Equipment carries a 1-year warranty (365 calendar days), which begins the day the equipment leaves our facility or on the invoice date, whichever comes first.
     
  2. Should any equipment manufactured by Enviro‐Equipment become defective within the warranty period, Enviro‐Equipment will evaluate the equipment with the labor required for the evaluation free of charge. This evaluation will be performed either at our facility in Pineville, NC, or in the field, at Enviro‐Equipment’s discretion. Travel expenses required to perform the field evaluation, including airfare, fuel, mileage, food, lodging, and travel time, are the responsibility of the buyer. If Enviro‐Equipment deems the equipment defective NOT due to the negligence of the buyer, the buyer’s employees, agents, or others, Enviro‐Equipment will repair the equipment at our Pineville, NC facility or in the field, with parts and labor free of charge. If the defective equipment is beyond repair, Enviro‐Equipment will replace the item with equivalent new equipment. Travel expenses required to perform a field repair, including airfare, fuel, mileage, food, lodging, and travel time, are the responsibility of the buyer.

Used Equipment

  1. All used equipment is sold "as is" with no warranty.
     
  2. All used equipment will be thoroughly tested, and the tests documented to prove the equipment is in good working order prior to shipment, delivery, or buyer pickup. The buyer has the option to inspect equipment or view test runs in person at Enviro‐Equipment Inc.’s Pineville, NC facility. The buyer accepts full responsibility for the equipment once it is picked up, delivered, or shipped.

Returns

  1. All new equipment items not manufactured by Enviro‐Equipment are subject to the manufacturer’s return policy, and any costs resulting from the manufacturer’s return policy will be at the buyer's expense. All new equipment returns are subject to a 10% restocking fee in addition to any manufacturer restocking fees. All special orders are non-returnable. All returnable items must be in new, unused, resalable condition and in original packaging. All freight costs incurred due to returns are at the buyer's expense.
     
  2. All sales of used equipment are final.
