By completing a purchase the customer acknowledges that this is not an N95 NIOSH rated mask meeting 42 CFR84, this mask is a KN95 meeting Chinese Standard GB2626-2006.
The KN95 Mask (Product) being sold by Enviro-Equipment, Inc (EEI) and purchased by Customer is being sold AS IS WITHOUT WARRANTY AND WITH ALL FAULTS. Customer acknowledges that the proper use of the Product may require verification of performance levels (i.e. ASTM filtration levels for masks), maintenance and training which shall be the sole responsibility of Customer.
EEI, including its officers, directors, employees, and agents, makes no representations whatsoever, extends no warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose, and assumes no responsibilities whatsoever with respect to design, development, manufacture, or use of the Product.
Customer by acceptance of the Product does hereby waive, release, and discharge any and all claims for damages for personal injury, death, property damage, any claim in tort, or any other claim, regardless of legal theory, that may hereafter accrue as a result of the use of the Product. The entire risk as to the performance of the Product is assumed by the Customer. In no event shall EEI or its officers, directors, employees or agents, be responsible or liable for any direct, indirect, special, incidental or consequential damages, lost profits, or any other economic or physical loss or damage to any individual regardless of legal theory resulting from use of the Product. The above limitations on liability apply even though EEI may not have advised of the possibility of
such damage.
Customer agrees to indemnify, defend and hold harmless EEI, its officers, directors, employees and agents from any and all claims, liability and damages arising from the use of the Product.
CUSTOMER HAS CAREFULLY READ THIS WAIVER OF LIABILITY AND INDEMNIFICATION AGREEMENT AND UNDERSTANDS ITS CONTENTS. CUSTOMER IS AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN CUSTOMER AND EEI.
